Octopus Electroverse US LLC (“Electroverse”, “we”, “our”, or “us”) respects your privacy and are committed to protecting it through our compliance with this policy. This policy describes how we collect, process, retain, and disclose personal data about you when providing services to you through our website, application, software and services that link to this policy (our “Services”) and our practices for using, maintaining, protecting and disclosing that information.

  1. Personal Information - Collection and Uses

    “Personal Information” is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, or payment information. We collect Personal Information directly from you, from third parties, and automatically through your use of our Services. We may combine the information we collect from these various sources. We do not sell this information and will not pass it on to third parties except as described herein.

    1. Account and Registration Information. We will only collect information about you that we need for our business functions. For example, we collect information from you when you sign up for an account, including your name, email address, phone number and account address.

    2. Precise Geolocation Information. If enabled by you within the Service or via the settings on your mobile device.

    3. Vehicle Type and commercial information. Charging session information and user history (charge location, charge delivered, frequency, etc.)

    4. Content posted to the Service. Personal Information contained in content posted by you to the Service (such as comments, suggestions, photos, feedback and reviews).

    5. Internet information. Such as your IP address, type of browser, version of operating system, carrier and/or manufacturer, device identifiers, and mobile advertising identifiers.

    6. Payment Information. Including credit card or debit card information you use in connection with the Services.

  2. Electroverse’s Use of Personal Information

    Where we do process your personal data, we rely on legitimate interests to process your data. We may use your personal information for the following purposes:

    1. Storage, processing and retention

      • To provide the features and functionality of the Service, enabling mobile solutions for electric vehicle fleets to connect drivers with charging resources.

      • We use precise geolocation information to provide the Service, including to (i) show chargers near you, (ii) help route you to a charging station you’ve selected, and (iii) prompt you to initiate charging if your location is shown at the selected station.

      • To authenticate users of the Services.

      • To provide customer support.

      • To respond to requests or inquiries.

      • To effectuate or enforce a transaction or agreement.

      • To adjust offerings or services provided by us to you.

      • To provide you with information about our products and services that we believe you may find of interest, including to send you mailing lists, and marketing and promotional e-mails.

      • To improve the Service and offerings or services provided by us and to better understand how users access and use the Service and offerings provided by us.

      • To comply with applicable legal or regulatory obligations, including as part of a judicial proceeding.

    2. Cookies, beacons and analytics

      When you interact with the Service, we strive to make your experience easy and meaningful.  The Service may use technology, some of which may belong to third parties, such as cookies, web beacons and similar technologies to track user activity and collect site data.  We may combine this data with the Personal Information we have collected from you.

      1. Cookies

        We (including third parties we work with) may use cookies to track visitor or user activity on the Service. A cookie is a text file that a website transfers to your computer’s hard drive for record keeping purposes. Our cookies assign a random, unique number to each visitor’s computer. They do not contain information that would personally identify the visitor, although we can associate a cookie with any identifying information that is or has been provided to us while visiting the website or using the Service. We use cookies that remain on your computer for a specified period of time or until they are deleted (persistent cookies). We may also use cookies that exist only temporarily during an online session (session cookies)—these cookies allow us to identify you temporarily as you move through the website or Service. Most browsers allow users to refuse cookies but doing so may impede the functionality of some portions of the Service.

      2. Web Beacons

        Web beacons are tiny graphics with a unique identifier, similar in function to cookies, that are used to track the online movements of Web users. In contrast to cookies, which are stored on your computer’s hard drive, web beacons are embedded invisibly on webpages and may not be disabled or controlled through your browser.

      3. Third Parties

        As noted, we may also engage third parties to track and analyze activity within the Service on our behalf. To do so, these third parties may place cookies or web beacons to track user activity within the Service. We use the data collected by such parties to administer and improve the quality of the Service, analyze usage of the Service, and provide a more enhanced user experience within the Service, such as personalizing and delivering relevant offers and content based on user activity within the website.

  3. How we Share/Disclose your Information

    We may share/disclose your information, including Personal Information, to third parties for the following purposes:

    • To provide the Service.

    • We may share information that may be considered Personal Information with charging station partners, most commonly in connection with customer service issues. Some charging networks require unique customer identifiers that may be combined with other information chargers collect, including type of car, range, location of charging station, and charge acquired. We may also share anonymized charging session information with charging partners.

    • We may share Personal Information with service providers who help us provide the Service; for example, providers who host our infrastructure or furnish payment processing or navigation services.

    • To provide you with information related to products or services that we believe you may find of interest.

    • With marketing partners and platforms, including social media advertising services, advertising networks, third-party data providers, and other service providers to reach or better understand our users and measure advertising effectiveness.

    • In response to a subpoena or other legal process by a governmental entity or third party, or if otherwise required by law.

    • To protect or enforce our rights including with respect to our assets and properties; for example, around an insurance claim or the resolution of a dispute.

    • In the event of the sale or dissolution (bankruptcy) of assets, in whole or in part, of our business or any of its affiliates.

  4. Your Rights and Choices about your Information

    1. User Settings

      Electroverse endeavors to minimize the Personal Information it processes.  You may configure your settings to further minimize your data footprint, including by: (i) opting out of marketing communications, (ii) opting out of notifications related to charging activities, (iii) making use of browser settings to reject unnecessary cookies, (iv) turning off geolocation information (however, if you block the use of location information, some Services features may become inaccessible or not function properly); or (v) elect not to provide Electroverse with vehicle information.

    2. Your rights

      You may have the following rights with respect to your Personal Information that is processed by Electroverse in particular jurisdictions, depending on whether Electroverse is subject to the jurisdictional reach of the applicable laws.  To exercise these rights, contact dpo@octoenergy.com. These rights include:

      1. Access. You have the right to know what Personal Information belonging to you we have collected.

      2. Correction. You have the right to correct any incorrect Personal Information that we have on file.

      3. Deletion. You have the right to request that we delete your Personal Information. We may not be able to delete every record—for instance, if you may a deletion request and we are required to keep such data for anti-fraud or security reasons or to comply with record retention requirements.

      4. Opt-out of sales, sharing and profiling. Electroverse does not sell your Personal Information or share it for the purposes of targeted advertising or profiling.

      5. Opt-out of direct marketing communications. You have the right to opt out of marketing communications we send you at any time. You can exercise this right at any time by following the opt-out link or instructions included in our marketing emails. Alternatively, or to opt out of other forms of marketing (such as postal marketing or telemarketing), please contact us at privacy@electroverse.com. Please note that it may take a few business days for us to process opt-out requests and we will need to retain your Personal Information as needed to honor your opt-out request. If you opt-out of receiving marketing emails or promotions, we will still send you service-based emails where requested by you, or in reference to other customer service purposes in accordance with this Privacy Policy.

  5. Security

    We maintain administrative, technical and physical safeguards designed to protect the privacy and security of the information we maintain about you.  Among other protections, these safeguards are designed to restrict access to your information to those Electroverse employees, other personnel, and contracted agents, that need access for an identified business purpose.  Please note that no electronic transmission of information can be entirely secure.  We cannot guarantee that the security measures we have in place to safeguard information will never fail, or that those measures will always be adequate or effective.  If we experience a significant data breach that involves your Personal Information, we will notify you, as required by law.

  6. California Consumer Privacy Act

    If you are a California resident, please review our California Privacy Notice at Collection regarding additional information about our processing of your Personal Information.

  7. Children's Data

    Our Service is not intended for, and we do not knowingly collect any personal data from children under the age of 16.  If we learn we have collected or received personal data from a child under 16 years old without verification of parental consent, we will delete that information.

  8. Changes to Our Privacy Policy

    We may update this policy from time to time, and we will provide notice of any such changes to the policy as required by law.  The date the privacy policy was last updated is identified at the top of this page.  We will notify you of changes to this policy by updating the “last updated” date and posting the updated policy on the Service.  We may email or otherwise communicate reminders about this policy, but you should check our Service periodically to see the current policy and any changes we have made to it.  If you do not agree to any of these terms or any future Privacy Policy, do not use or access (or continue to access) the Services.
